ANEEL ends 2025 with key decisions for the North and Northeast regions.

The last meeting of the year addressed concession renewals, tariffs in Amapá, isolated systems, and hourly tariffs.

The last ordinary public meeting of the board of directors of 2025. ANEEL (National Electric Energy Agency), held this Tuesday (9), was one of the most dense of the year. In total, 55 items made up the agenda, ranging from concession renewals to critical problems in the supply of energy in remote regions of the North.

A ANEEL The Brazilian Ministry of Mines and Energy (MME) recommended the renewal of the concessions for Neoenergia Cosern, Neoenergia Coelba, and Energisa Mato Grosso. However, the process concerning Enel-CE took a different turn after director Gentil Nogueira requested a review, temporarily halting the decision on the company.

According to the opinion of rapporteur Fernando Mosna, Enel-CE failed to meet the criteria of Decree 12.068/2024, especially regarding the continuity of supply indicator, exceeding the global DEC limits for three consecutive years.

DEC (Equivalent Interruption Duration per Consumer Unit) is an indicator regulated by ANEEL which measures the average time in hours that consumers in an area were without electricity during a certain period. The distributor requested that an investment plan approved by the Ministry of Mines and Energy (MME) be considered to meet the criteria by May 2028, but Mosna understood that there is no basis for a positive recommendation at this time.

Director Gentil Nogueira agreed with the diagnosis, but requested legal advice to determine how to operationalize a possible decision by the Ministry of Mines and Energy (MME) should the ministry choose to renew the concession even without the recommendation of the... ANEEL.

Political pressure

Another topic of great repercussion involved the tariff readjustment of CEA Equatorial, in Amapá. The technical area predicted a 24% increase, but the matter was removed from the agenda after a request from the company itself and pressure from state parliamentarians.

Senators Davi Alcolumbre and Randolfe Rodrigues sent an official letter to ANEEL requesting the postponement, based on the new rules of Law 15.235 and Law 15.269, which authorize the use of UBP (Use of Public Assets) resources to reduce readjustments in the North and Northeast regions. It is estimated that an investment of approximately R$ 140 million could reduce the increase by up to 10 percentage points.

A ANEEL It must convene an extraordinary meeting to deliberate on the use of UBP resources exclusively for tariff moderation in the state. In this context, director Agnes Costa was chosen by lot to report on the process regarding the allocation of resources.

Northern region on alert.

And the situation of isolated systems has once again become a concern for the regulatory agency. ANEEL approved sending an alert to the Ministry of Mines and Energy (MME) regarding the risk of power supply interruptions in areas served by BBF (Brasil BioFuels) plants, which supply communities in Acre, Rondônia, and Amazonas.

The company's deteriorating economic and financial situation prompted the decision to authorize the direct transfer of the CCC (Fuel Consumption Account) to BBF's suppliers. Although an emergency measure, it was considered "precarious" by the reporting director, Mosna, who stressed the need for a long-term solution.

At the same time, the distributors Amazonas Energia, Equatorial Pará, and Energisa Acre were notified to take steps to guarantee local supply while a process is underway regarding the possible termination of the concessions for BBF's power plants due to financial sustainability failures.

The extensive agenda of the last Aneel meeting summarizes a 2025 marked by regional challenges, tariff pressures, structural weaknesses, and debates on regulatory modernization.

The board concludes the year with decisions that directly influence the continuity of the service, the financial sustainability of agents, and the sector's preparation for a cycle of more profound changes in 2026.
