A ANEEL (National Electric Energy Agency) opened Public Consultation No. 23/2025 for the evaluation of a study on international experiences in the valuation of costs and benefits of distributed generation (DG).
The initiative also seeks to gather regulatory alternatives for the application of Article 17 of Law No. 14.300/2022, which establishes the tariff rules for consumer units with their own generation.
The purpose of this Public Consultation is to gather input from society and collect technical contributions to support the regulation of this topic. The period for submitting contributions runs from December 4, 2025 to March 4, 2026, through the document exchange modality, via... available form on the Agency's website.
According to Article 17 of Law No. 14.300/2022, consumer units are billed based on the incidence, on the active electrical energy consumed from the distribution network and on the use or demand, of all tariff components not associated with the cost of energy, with all benefits to the electrical system provided by distributed generation plants being deducted.
In the law itself, the guidelines for valuing the costs and benefits of the modality were assigned to the CNPE (National Council for Energy Policy), with a deadline of up to six months from the publication of the law, while the ANEEL They would have up to 18 months, also counted from the enactment of the law, to establish the methodology for calculating the valuation of benefits. However, these deadlines have expired more than two years ago.
Following the expiration of the transition periods stipulated in Law No. 14.300/2022, the consumer unit participating in the SCEE (Electric Energy Compensation System) will be billed under the same tariff modality defined in the regulation of ANEEL for their respective consumption class.
