CCEE (Chamber of Electric Energy Commercialization) will have to pay R$ 1,4 million to Newave Energia, the controlling company of the solar power plants at the Arinos Complex in Minas Gerais.
Sought by Canal Solar, Newave informed that, for now, it will not comment, since the matter is still under judicial review.
In a statement, CCEE reported that “it was notified of the court decision this Tuesday (23) and that it is evaluating its content based on the regulatory and operational rules of the electricity sector to adopt the appropriate measures, within the technical and legal limits that guide its actions”.
The preliminary injunction was issued by the TRF-1 (Federal Regional Court of the 1st Region) and refers to generation cuts classified as "constrained-off due to external unavailability," already technically recognized by the ONS (National System Operator). The information was released by MegaWhat and confirmed by industry sources interviewed for this report.
The case involves seven photovoltaic solar power plants that failed to generate approximately 13,6 GWh, resulting in the losses now recognized by the courts. The decision, signed by Federal Judge Newton Ramos, grants a stay of execution to an appeal by Newave against the first-instance ruling that had dismissed the injunction without a judgment on the merits.
Therefore, CCEE (Brazilian Chamber of Electric Energy Commercialization) will have to make the payment in the next accounting cycle of the MCP (Short-Term Market). The merits of the case will still be judged by the panel of the 11th Chamber of the TRF-1 (Regional Federal Court of the 1st Region), but the injunction has immediate effect.
O The Arinos Complex is located in the municipality of Arinos (MG). and involved a private investment of R$ 1,42 billion, attracted with support from the Government of Minas Gerais, through the State Secretariat for Economic Development and Invest Minas.
The project, developed by Newave Energia SAThe plant has an installed capacity of 435,8 MWp and has generated approximately 300 direct jobs in the region, in addition to contributing to the expansion of solar energy generation in the state. The structure also received investments from Gerdau, one of the largest steel companies in the country, and the brokerage firm XP.
