Congress approves Provisional Measure 1.304 without charges for distributed generation.

After an intense day of discussions, which included votes in the Joint Committee, in the plenary of the Chamber of Deputies and in the Federal Senate, the text of Provisional Measure 1.304/2025 was approved and sent for presidential sanction.

The final version excludes the charge of R$ 20,00 for every 100 kWh offset by new distributed generation (DG) projects — a provision originally proposed by the rapporteur, Senator Eduardo Braga (MDB-AM), and approved by the Joint Committee of the report — but withdrawn hours later by the Chamber of Deputies during the vote on the main text.

The approval was considered a victory for solar energy, guaranteeing legal certainty and regulatory predictability for investors and consumers. According to associations that advocate for the sector, the text reaffirms that distributed generation (DG) is part of the national energy solution.

Chamber rejects tax proposed by Braga.

In the Chamber of Deputies, representatives approved, by 233 votes to 148, the removal of the article that created a charge on energy compensated in distributed generation. The measure was orchestrated by parliamentarians Lafayette de Andrada (Republicanos-MG) and Pedro Uczai (PT-SC), who defended the issue in plenary and managed to mobilize different political groups.

The Chamber of Deputies removes the tax on distributed generation in the report on Provisional Measure 1.304.

Senate confirms approval without changes.

Immediately after the vote in the Chamber of Deputies, the Federal Senate confirmed the text without modifications, concluding the legislative process. measure In Congress, this means there will be no additional tariff for micro and mini-distributed generation systems, whether for local or remote self-consumption. MP 1.304 now goes to the President for approval.
