Enel São Paulo, the concessionaire responsible for distributing electricity in the city of São Paulo and municipalities in the Metropolitan Region, was fined R$ 14 million for supply failures recorded at the end of last year.
The penalty was applied this Wednesday (14) by Procon-SP, after receiving several complaints from consumers. According to the agency, the fine refers to interruptions that occurred between September 21 and 23 and between December 8 and 14, periods in which residents reported power outages for more than 48 hours.
According to Procon-SP (São Paulo's consumer protection agency), the situation constitutes a violation of Article 22 of the CDC (Consumer Protection Code), which stipulates that concessionaires, companies, or public bodies are obligated to provide adequate, efficient, safe, and, in the case of essential services, continuous services.
The distributor's history of fines also weighs against the company. Since 2019, Enel has already been fined nine times by Procon. In December of last year, the concessionaire was also penalized by Procon Paulistano, an agency linked to the São Paulo City Hall, with a fine of R$ 14,3 million.
What does Enel say?
In a note sent to Canal SolarEnel São Paulo reported that it submitted its defense to Procon-SP within the established deadline and is awaiting the continuation of the process. The distributor also argued that it has improved its contingency plan to reduce the impacts of severe weather events.
“Among the measures adopted are the reinforcement of field teams according to the weather forecast, the hiring of more in-house electricians, the increase in the fleet of generators, the expansion of service channels, and the intensification of preventive maintenance. In 2025, the company collaboratively doubled the number of branch trimmings near the power grid, exceeding 650 interventions in the year,” the company reported.
Enel also highlighted in the document that on September 22, 2025, heavy rains and winds with gusts of up to 98 km/h hit the concession area and that, even so, the company restored power to 95% of affected customers within 24 hours.
According to the company, this would have been the highest percentage of recovery in that timeframe for high-impact weather events. "On December 10th and 11th, it faced an extratropical cyclone with intense winds for up to 12 hours, mobilizing approximately 1.700 teams in the field. For the next three years, Enel will expand its investments in São Paulo, reaching R$ 10,4 billion by 2027."
