The Governor of Piauí wants to change the rules of the GD (General Distribution) in Law 14.300.

The governor of Piauí, Rafael Fonteles (PT), stated that he will send an official letter to the state's federal representatives suggesting changes to Law 14.300/2022 – which established the rules for the operation of distributed generation (DG) in the country. The statement was made via his social media.

According to the governor, the proposal aims to discuss adjustments to legislation related to the participation of photovoltaic generators in the costs of using the electricity grid. Since this is a federal law, any changes to the regulation can only occur through the National Congress.

Therefore, Fonteles' initiative consists of suggesting that deputies and senators debate the rules for distributed generation's contribution to the costs of the electricity grid.

In a press release, the government of Piauí stated that Law 14.300 "determines that those who generate solar energy must also contribute to part of the costs of using the electricity grid of the concessionaire for the distribution of surplus energy produced, just like conventional consumers."

Commenting on the topic, the Secretary of Finance of Piauí, Emílio Júnior, said that today consumers' electricity bills include different components that go beyond the electricity produced.

In this sense, the manager emphasizes that if these charges are not shared in a balanced way, consumption ends up being transferred to those who do not have their own generation. "The cost of the grid exists and needs to be paid. When those who have solar energy do not participate in this cost, it ends up being passed on to those who do not have their own generation," he stated.

    This Governor is lost; doesn't he know that payment was already being made for the use of the system as a minimum fee, and now with Law 14300, it has become clear once again that payment is required for the use of the grid, and that the use of distributed generation benefits the concessionaire by avoiding losses in sending energy over long distances that is consumed next to the generation site?

It's fine with others, but there are others who get discounts, or only on Bolsa Família (a Brazilian social welfare program). We invest in our energy production to get a discount, but we spend more on this to get a return.

    The collection of ICMS (a Brazilian state tax) on energy offset in distributed generation carried out by the Government of Piauí continues to be a subject that generates much debate. In the energy compensation system, there is no circulation of goods, but only the deduction of energy that the consumer himself generated and injected into the grid.

    Furthermore, the Court of Justice of Piauí itself has already recognized this understanding in decisions that question this charge. Therefore, insisting on the application of ICMS in this situation demonstrates a position that contradicts the legal interpretation already presented by the state's own judiciary.

    It's astonishing how unprepared a state governor can be when making a comment, not even bothering to study the situation before speaking, since Law 14300/22 already has a financial system for compensating the use of the network! This is the "Fio B" charge, and why does this governor want to help the concessionaire with the compensation? Is he a partner? Did he receive a donation from the concessionaire during his campaign? Or is it because he was exposed by a citizen due to the unfair "ICMS" charge? In short, the people can no longer tolerate paying taxes and receiving nothing in return!!!

    Good morning! I'm an integrator here in the state of Piauí.
    In my opinion, the governor is trying to buy time, attempting to manipulate the minds of the people of Piauí so as not to remove the ICMS tax on the compensated value. Law 14300 does not address the collection of ICMS by the state. It is he, the governor, who needs to redeem himself and be loyal to the people of Piauí. He needs to show that he is on the side of the taxpayer.
    In my opinion, I think he's acting like an emperor; he's actually trying to win by appealing to the public outcry and social media denouncing this alleged improper tax collection. If he goes to the federal congress and secures a majority, he'll create parameters in Law 14300 that favor the collection of this undue ICMS (a state sales tax). In short, he could affect all of Brazil with this evil idea.
