The MME (Ministry of Mines and Energy) sent a letter to the CGU (Office of the Comptroller General of the Union) requesting “urgent corrective measures” to determine the responsibility of the board of directors of ANEEL (National Electric Energy Agency) for delays in the progress of processes, especially the approval of the new statute for the CCEE (Electric Energy Trading Chamber). The document was signed by Minister Alexandre Silveira and addressed to the Minister of the CGU, Vinícius de Carvalho.
Silveira stated that “consistent unjustified delays” have negatively impacted the implementation of public policies and cited, in addition to the CCEE statute, the lack of progress in regulating pole sharing as provided for in a 2023 interministerial ordinance.
The letter reiterates a similar request sent to ANEEL in October 2024, when the minister had already called for action in the face of delays and warned of possible intervention if the “inertia” persisted.
The new request to ToU occurs after a director of ANEEL, Director-General Sandoval Feitosa, submitted a request for review, which suspended the statute's approval. The process had been marked by impasses since 2024.
The agency had identified irregularities in the text originally approved by CCEE members and ordered adjustments. The rapporteur and directors, including Ricardo Tili and Ludimila Silva, cast votes. More recently, director Fernando Mosna submitted a favorable vote, excluding a section, and Feitosa's request for review interrupted the conclusion.
The lack of a fifth director in the ANEEL would, however, have contributed to ties and postponements of decisions. In a statement, the ANEEL stated that it had not been officially notified of the letter to the CGU and did not comment on the case.
Silveira also linked the issue to previous criticisms of "politicking" at the agency and called for speed in processes such as the renewal of distribution concessions, the delay of which, according to him, hinders the modernization of the electricity sector.
The CGU must evaluate the letter and decide on the adoption of corrective measures and the investigation of responsibilities within the board of directors. ANEEL.
