After being approved last week in the Senate, Bill No. 327/2021 – which establishes Paten (Energy Transition Acceleration Program) – was analyzed by the CI (Infrastructure Services Committee) and was forwarded to the Plenary as a matter of urgency, without the need for analysis by other committees.
As the approved text has undergone some changes, the Bill will return to the Chamber of Deputies for further analysis. The expectation is that the vote will take place in the coming days, before the parliamentary recess.
According to Bruno Herbert, the president of Abesco (Brazilian Association of Energy Conservation Services Companies), the proposal aims to boost sustainable development in the country, especially through projects that promote energy transition and technological innovation.
He explains that the main areas of incentive include the growth of renewable sources, including solar, wind and biomass energy, in addition to the development of renewable fuels and the replacement of fossil fuels with clean alternatives.
“This approval is a milestone for Brazil, which wants to consolidate itself as a global leader in sustainability,” says Hebert.
The president also cites Amendment 31, which promotes changes to article 18, adjusting provisions of Law 9.991/2000:
Article 1:
Concessionaires and licensees of public electricity distribution services must apply, annually, at least:
- 0,50% (fifty hundredths of a percent) of its net operating revenue in research and development (R&D) in the electricity sector;
- 0,50% (fifty hundredths of a percent) in energy efficiency (EE) programs.
The following provision is also included:
“Concessionaires and licensees may apply energy efficiency resources to install electricity generation systems in quilombola, indigenous, riverside, traditional peoples and isolated communities, when technically feasible and previously authorized, with the aim of complying with the provisions of this law, in accordance with the regulations.”
Article 5-B:
Resources not committed to projects contracted or initiated at the end of each annual exercise must be allocated to Spanish Sporthorse (Energy Development Account) to promote tariff affordability in the subsequent period.
“This result reflects the agreements articulated and reaffirmed with the senators involved and with the government leadership, culminating in the approval of the project by the Senate Plenary”, explains Herbert.
Furthermore, the PATEN also foresees the creation of the Guarantee Fund for the Green Fund for Sustainable Development. The idea is that it will be one of the main financing tools. In addition, the fund will have the function of leveraging projects that reduce environmental impacts and bring socioeconomic benefits.
