Federal deputy Arnaldo Jardim (Cidadania/SP) participated this Tuesday (2) in the 1st Sector Analysis Forum, promoted by CCEE (Electric Energy Commercialization Chamber), in partnership with Dominium Group.
For the congressman, industry players need to form a pact to face the current challenging times. Otherwise, it will be difficult for the provisional measures currently under consideration in the National Congress to achieve a positive outcome.
Jardim stated that the sector is ripe for comprehensive reform. According to him, the energy generation profile has changed profoundly—not only due to the advancement of distributed generation, but also due to the intermittency of renewable sources.
Furthermore, the free market is booming, and digitalization, combined with the impact of artificial intelligence, is already changing the sector's dynamics. "Everything that was already a challenge and required reform has worsened over time," he assessed.
The deputy also said that he spoke with the Minister of Mines and Energy, Alexandre Silveira, so that issues such as curtailment and energy storage were incorporated into MP 1.304/2025, which deals with the creation of a ceiling for the CDE (Energy Development Account).
"The CDE ceiling deserves a separate chapter. I consider it a positive idea to establish a limit, because if the budget is not well managed, it could deepen distortions in the sector. I have also discussed with market representatives the possibility of, if there is a general ceiling for the CDE, why not establish specific ceilings for different segments? This would avoid internal disputes within the sector," he stated.
Another amendment suggested by Jardim is to allow some of the energy contracted by free consumers to come from distributed generation. "Today, the major issue that has brought us to this challenging situation is the accumulation of sectoral distortions. If we can't find a balance, it will be very difficult to overcome this situation," he concluded.
