ANEEL approves draft notice of the first transmission auction of 2024

Dispute is scheduled for March 28, expected to attract R$ 18.2 billion in investment

With expectation of investments of R$ 18.2 billion, The ANEEL (National Electric Energy Agency) approved this week – and has already forwarded to the TCU (Federal Audit Court) – the draft notice for the first transmission auction in 2024, which foresees the construction of 6,464 kilometers of transmission lines It is 9,200 MVA in power transformation capacity. The event is scheduled for March 28, at B3 headquarters, in São Paulo.

O auction will be divided into 15 lots (Click here) and, according to ANEEL, the implementation of 69 projects should create 35 thousand direct and indirect jobs.

The projects will generate investments in the states of Ceará, Piauí, Rio Grande do Norte, Paraíba, Pernambuco, Alagoas, Bahia, Minas Gerais, Tocantins, Rio de Janeiro, Santa Catarina, São Paulo, Mato Grosso do Sul and Maranhão.

Most projects aim to expand the Basic Network to enable the flow of renewable energy plants in the Northeast region, with emphasis on wind and solar plants.

Stricter rules

After the negative experience with the Gênesis Consortium, ANEEL took new precautions to prevent companies with no history in the electricity sector from participating in the event.

Companies that win the auction will need to show that they have already carried out similar work, corresponding to at least 30% of the project size of the lot in dispute.

If it is a transmission line, this percentage will be equivalent to the project length at the same voltage. In the case of a substation or installation of equipment, the power of the project or equipment will be taken into account.

Furthermore, the requirements for the financial and economic capacity of the proposing companies will be changed compared to previous notices. The winning company must present financial statements, accompanied by an opinion from an independent auditor registered with the CVM (Securities Commission).

“If the winning bidder is disqualified, the remaining bidders will be called, in ascending order of the bid values offered in the auction, to present the qualification documents, provided they accept the financial proposal presented by the disqualified bidder. If none of the remaining parties accepts the financial proposal offered by the disqualified party, the ANEEL Special Auction Committee may summon them to present, in an extraordinary public session, an envelope containing an additional proposal or expression of non-interest. If one or more proposals are presented that are lower than the one ranked second in the auction, the participant offering the lowest Allowed Annual Revenue (RAP) will be invited to present the qualification documents. If there is no proposal at the time, the runner-up will be invited to present the qualification documents during the auction, at the value of their own bid”, ANEEL said in a note.

The Gênesis Consortium, formed by shareholders The Best Car Transportes de Cargas and Entec Empreendimentos, was the main winner of the first transmission auction held on June 30, when it won lots 1 and 8, with an expected investment of R$ 3.4 billion.

However, the consortium was disqualified for not presenting the necessary documentation. ANEEL imposed a fine of R$ 34.1 million. The companies that formed the consortium had never participated in investments in the electricity sector.

The second transmission auction of 2023 will be held on December 15th, with investments totaling R$ 21.7 billion. 9 lots will be tendered, totaling more than 3 thousand kilometers in transmission lines and sections and 9,840 MVA in conversion capacity in substations.
