ANEEL Equatorial Goiás fined for misuse of data

A ANEEL The Brazilian Electric Energy Agency (Agência Nacional de Energia Elétrica) has fined Equatorial Goiás Distribuidora de Energia, the state's electricity supplier, R$15 million. The penalty was formalized through Violation Notice No. 24/2025, within process 48500.006496/2023-15.

The decision is the result of a supervisory action by ANEEL, initiated after allegations of practices that violate free competition. According to the Agency, the distributor had improperly shared consumer data with a retailer within the same economic group, generating a competitive advantage in the free energy market.

The investigation was supported by the Federal Prosecutor's Office along with ANEEL and concluded that the conduct constitutes a serious violation, according to Normative Resolution No. 846/2019, which regulates information sharing in the electricity sector. The agency emphasized that the case reinforces the need for transparency and equality among market participants.

“This infraction notice demonstrates the commitment of ANEEL with the gradual opening of the market and the promotion of fair competition between agents in the electricity sector,” the National Electric Energy Agency said in a statement.

In accordance with the company's own procedures ANEEL, Equatorial Goiás may still present a defense. The case will subsequently be reviewed by the Board of Directors, which will make a final decision on the penalty.

Equatorial Goiás informs that the process with the National Electric Energy Agency (ANEEL) is still ongoing and is not a final decision by the regulatory body, and therefore an appeal can be filed with the competent administrative bodies.

The Distributor continuously follows and monitors the progress of the case, ensuring that all questions and pertinent information are duly handled by the Agency.

Equatorial Goiás reaffirms its commitment to full compliance with Brazilian legislation and regulatory standards applicable to the electricity sector, including the provisions of the General Personal Data Protection Law (LGPD).

Finally, the company emphasizes that it continues to collaborate permanently with the competent bodies, in full alignment with current regulatory guidelines and its commitment to operating ethically, responsibly, and with respect for society.
