The voluntary assignment of distributed generation credits during the coronavirus pandemic could become law. The PL (Bill of Law), authored by federal deputies Franco Cartafina (PP/MG) and Lucas Redecker (PSDB/RS), was filed on Thursday (7) in the Chamber of Deputies.
If approved, the law will allow the credits to be used by hospitals and other essential public services aimed at social assistance or combating Covid-19. The measure was suggested by entrepreneur Ricardo Rizzotto and taken to parliamentarians by ABSOLAR (Brazilian Photovoltaic Solar Energy Association), as reported by the Canal Solar this week.
According to the text presented by the deputies, the transfer may occur exclusively for consumers classified as a public service; hospitals and suppliers of hospital medical services and products; entities that care for the elderly or that develop long-term institutionalization programs; and non-profit legal entities recognized as charitable social assistance entities for the purpose of providing services in the areas of social assistance, health or education.
Still according to the proposal, the objective is not to regulate REN (Normative Resolution) 482 of the ANEEL (National Electric Energy Agency), but aims to establish additional guidelines to be followed in the application of the current energy policy, which must be observed to update the regulation.
For lawyer Bárbara Rubim, vice president of Distributed Generation at ABSOLAR, the presentation of the proposal via a bill speeds up the process. “The presentation via a bill is very important because we have two ways of having this measure implemented. The first would be via ANEEL, by a decision of the board, and the second copy of the bill. Decision-making in ANEEL is slow due to the Covid-19 pandemic and the agency has focused on taking only emergency measures.
So, the arrival of a bill gives a greater chance of turning this proposal into reality. Furthermore, it guarantees immediate effectiveness and the impossibility of the impact of forces from other agents that could eventually be contrary to the measure”, says Bárbara.
The proposal will be analyzed by the responsible committees and then taken to the Plenary. The matter can be followed on the Chamber of Deputies website.
