Chamber accepts amendment that allows deforestation by the energy sector

A Câmara dos Deputados approved, last Thursday (30), the 1.150 Provisional Measure, which changes the deadline for the owner or squatter of rural properties to join the Environmental Regularization Program (FOR). The PM will be sent to Senate.

According to the wording given by the federal deputy's amendment Daniel Agrobom (PL-GO), approved and accepted by the Plenary, the new deadline will be one year from the call by the environmental body. The deadline originally foreseen by the MP and initially maintained by the rapporteur, federal deputy Sergio Souza (MDB-PR), was 180 days.

This same MP accepted an amendment, by federal deputy Rodrigo de Castro (União-MG), which changes the Atlantic Forest Law to allow deforestation when implementing electricity transmission lines, gas pipelines or public water supply systems without the need for a prior environmental impact study (EIA) or compensation of any nature.

The capture, collection and transportation of wild animals will also be waived, with only their scaring being guaranteed. Other points of this amendment provide:

  • Secondary vegetation in the medium stage of regeneration may be cut down for public utility purposes even when there is a technical alternative or another location for the project;
  • Exemption from the prior consent of a state environmental agency and authorization now belongs exclusively to a municipal environmental agency for the cutting of vegetation in the medium stage of regeneration located in an urban area;
  • Land division for subdivision or building in an area of ​​secondary vegetation in a medium stage of regeneration in the Atlantic Forest may occur with authorization from a municipal body, which will no longer need to be obtained in advance;
  • Environmental compensation for the felling of primary or secondary vegetation in the medium or advanced stages of regeneration in the Atlantic Forest may occur in a neighboring municipality and, when involving an urban area, also with land located in permanent preservation areas;
  • The cutting or exploitation of secondary vegetation in the initial stage of regeneration in the Atlantic Forest may also be authorized by the competent municipal body.
