The restriction is valid until January 5, 2026, and authorizes interruptions only in duly proven emergency situations. The decision was issued by Judge Adria Josiane Muller Gonçalves Atz, of the Capão da Canoa District Court, following a formal request from the municipalities of both cities.
According to the documents, the concessionaire had announced scheduled power cuts for December 29th and 30th, just before New Year's Eve, a period when the regions receive many tourists due to the summer season.
Although CEEE Equatorial claimed that the outages were necessary to carry out maintenance and improvements to the electrical grid, the judge ruled that the chosen period could cause significant impacts on the community.
According to the judge, the significant increase in demand for public services during the peak season requires greater caution in providing an essential service such as energy supply.
In its decision, the court highlighted that scheduled interruptions in this context could compromise sensitive areas such as health, public safety, and urban mobility, as well as affect water supply and the operation of economic activities that directly depend on tourist flow for their viability throughout the year.
Based on Article 300 of the Code of Civil Procedure, the judge determined that the legal requirements for granting the preliminary injunction were met. In case of non-compliance, the concessionaire may be penalized with a daily fine of R$ 15, limited to a maximum period of 30 days.
