After much back and forth in the courts, Cemig was finally cleared to complete the sale of the four small hydroelectric plants auctioned in December 2024. The Court of Justice of Minas Gerais suspended the injunction granted by the 1st Public Treasury Court of Belo Horizonte (MG), which had halted the sale process.
The units, located in the municipalities of Machado Mineiro, Sinceridade, Martins, and Marmelos, were acquired by Âmbar Energia, part of the J&F group, for approximately R$ 52 million. This current release allows the Minas Gerais-based company to finalize, at least for now, a process that had been stalled for about twelve months.
The dispute began immediately after the auction. The 1st Court of Public Finance and Autonomous Entities of Belo Horizonte granted an injunction to suspend the processing of the sale of the rights to operate the power plants.
The decision originally responded to a public civil action filed by FTIU-MG (Federation of Workers in Urban Industries of Minas Gerais), which formally acted as the plaintiff, questioning the legality of the divestment promoted by the state-owned company.
With the injunction, not only were the effects of the auction paralyzed, but the entire administrative sales process was also halted, creating a legal impasse that dragged on throughout 2025. At the time, the cemig The company informed the market, through a statement, that it would appeal the decision, using all available legal instruments in higher courts.
Since then, the case has gone through a series of appeals and judicial reassessments. At different times, decisions favorable and unfavorable to the company have alternated, keeping the process under constant legal instability.
The initial suspension was challenged through appeals filed by Cemig itself, which maintained the legality of the auction and the divestment plan, arguing that the small hydroelectric plants were not part of the strategic core of its generation assets.
Throughout this period, the sale of the power plants remained unresolved, while the parties awaited the outcome of the legal proceedings. This uncertainty extended through much of 2025, affecting the timeline for transferring the assets to Âmbar Energia and also the allocation of the funds that would be raised from the operation.
Now, with the most recent decision, the court has removed the obstacles that prevented the sale from being finalized, allowing Cemig to definitively move forward with the process.
