The Federal Court upheld the fine of R$ 95,8 million imposed by ANEEL The Brazilian National Electric Energy Agency (ANEEL) fined Enel SP for failures in indicators of continuity of energy supply in 2021. The decision was made by the 4th Federal Civil Court of the Federal District, which considered the administrative process regular and validated the penalty.
The distributor claimed that the fine was disproportionate and argued that the decision had been influenced by an extreme weather event that occurred later. The judge rejected the arguments and understood that the sanction observed technical criteria, such as the severity of the infractions, harm to consumers, and any potential economic benefit.
Report points to flaws in December blackout.
In parallel, the ANEEL It concluded that Enel's performance during the blackout of December 10, 2025, was unsatisfactory. Wind gusts of up to 98 km/h left more than 2 million properties without power in the city of São Paulo and in 23 municipalities in the metropolitan region.
A technical report attached to the investigation process indicated low team productivity, a significant reduction in staff during the night shift, and evidence of failures or lack of maintenance on the network. According to the report, 46% of customers were without power for more than 24 hours, with some cases of restoration taking only five days.
Expiry process under review
Following the incident, representatives from the federal, state, and municipal governments announced their intention to begin the process of terminating the concession contract. Ministry of Mines and Energy informed that it will forward the information to ANEEL for evaluation.
Enel stated that it has complied with the Recovery Plan submitted to the agency in 2024 and declared that it will continue to demonstrate, in the competent instances, compliance with contractual and regulatory obligations.
