Federal agencies are called in to investigate failures at Enel SP.

The decision was motivated by the supply disruption that affected approximately 1,8 million consumers at the end of last year.

President Lula (PT) ordered, this Monday (12), that Federal Government bodies adopt measures to investigate failures in the supply of electricity in the Metropolitan Region of Greater São Paulo. The decision was motivated by the interruption in supply that affected around 1,8 million consumers at the end of last year.

In the order, Lula assigns responsibilities to the Ministry of Mines and Energy (MME), the Attorney General's Office (AGU), the Comptroller General's Office (CGU), and... ANEEL (National Electric Energy Agency). The measure is based on Article 84 of the Federal Constitution, which authorizes the President of the Republic to direct the federal public administration.

The president instructed the Ministry of Mines and Energy (MME), in coordination with the Attorney General's Office (AGU) and the Comptroller General's Office (CGU), to adopt all necessary measures, together with... ANEEL, to ensure the adequate, continuous and efficient provision of electricity distribution services to the population.

The order also stipulates that the Attorney General's Office (AGU) must prepare a detailed report on the measures taken by the concessionaire responsible for energy distribution in the Enel São Paulo concession area, since the first interruption considered significant.

To this end, the Attorney General's Office may use judicial and extrajudicial measures, in addition to requesting information directly from... ANEELThe Comptroller General's Office (CGU) will be responsible for investigating any potential liability of the federative entities involved, the concessionaire, and the regulatory agency itself. The agency will also investigate the reasons for the lack of timely action by the competent authorities.
