Consumers will choose their energy supplier like they choose their cell phone plan, says Voltera CEO.

After approval of the MP (Provisional Measure) 1.304/2025 In the National Congress, on October 30th — which gave rise to PLV (Conversion Bill) 10/2025 — the Brazilian electricity sector is preparing for a new phase marked by the full opening of the Free Energy Market and the creation of a regulatory framework for energy storage.

In the past few days, the Canal Solar had already addressed the topic of energy storage in an interview with Fábio Lima, executive director of ABSAE (Brazilian Association of Energy Storage Solutions) — one of the most anticipated points by the industry.

Recognition of storage in Provisional Measure 1.304 is a victory for the sector, says ABSAE.

Now, the Canal Solar spoke with Alan Henn, CEO of Voltera, a Brazilian company specializing in energy trading in the Free Energy Market, to explain how the measure changes the landscape for companies and consumers and what to expect from the complete opening of the market.

According to the executive, the approved text promises a more open, competitive, and efficient market. "With the approval of this provisional measure, the Brazilian electricity sector enters a phase of transformation and adaptation," he emphasized.

"Therefore, in the coming months, it will be crucial to pay close attention to the detailed regulations by..." ANEEL (National Electric Energy Agency) and by the MME (Ministry of Mines and Energy)”, he added.

What changes for the Free Energy Market?

Henn explains that the newly approved text brings structural changes to the segment in Brazil. He recalls that, historically, access to this market was restricted only to large consumers — companies with invoices above R$ 40 per month.

“In January 2024, we had the first major regulatory change: there was an expansion of access to this market, and from that moment on, any company in Group A, served at medium voltage, had the right to access this market,” he said.

However, he points out that the market was still eagerly awaiting the next structural regulatory advancement: full opening for any company or residence. "And the new provisional measure addresses exactly this new advancement," he emphasized.

The executive highlighted that, as soon as the new law is sanctioned by President Lula (PT), the opening of the Free Energy Market should be implemented gradually, according to the schedule foreseen in... PLV 10/2025.

The document provides (as shown in the image below) that industrial and commercial consumers will be able to access the free contracting environment up to 24 months after the law comes into effect, while others, including residential consumers, will have this right up to 36 months later.

"This means that Brazil is beginning to follow the same path as countries like Italy, Spain, and the United Kingdom, where consumers choose their energy supplier in the same way they choose their cell phone plan or their digital bank."

“For us at Voltera, this opening is a historic step forward. Giving consumers freedom of choice is the first step towards creating a more efficient, transparent and sustainable sector,” Henn concluded.
