Legal framework for low-carbon hydrogen will be signed next week, announces MME.

The Minister of Mines and Energy, Alexandre Silveira, stated that the decree regulating Laws No. 14.948/2024 and No. 14.990/2024 – responsible for structuring the Legal Framework for low-carbon hydrogen in Brazil – should be signed next week. The announcement was made this Thursday (13), during the COP 30, in Belém (PA).

Drafted through an interministerial effort, the decree was coordinated by the Ministry of Mines and Energy (MME), through the Management Committee of the National Hydrogen Program, and included the participation of the Ministry of Development, Industry, Trade and Services (MDIC) and the Ministry of Finance.

The text also incorporated contributions from industry representatives, researchers, and government agencies. According to the Ministry of Mines and Energy (MME), the draft underwent technical analysis by the relevant departments within the ministry and the Civil House of the Presidency of the Republic.

In March 2025, the ministry held a workshop with the sector to present the regulatory framework and the national strategy for low-carbon hydrogen. The regulatory framework establishes clear rules, legal certainty, and predictability to stimulate investment, innovation, and industrial competitiveness, the Ministry of Mines and Energy (MME) reported.

Key advances of the decree

The regulation will provide essential technical definitions to guide the low-emission hydrogen certification process in Brazil, including: life cycle assessment (LCA) criteria, greenhouse gas measurement methodology, and emission intensity and traceability parameters.

The text also details, according to the MME (Ministry of Mines and Energy), the operation of the SBCH₂ (Brazilian Hydrogen Certification System), which will establish institutional rules and competencies to guarantee credibility and quality to the national product.

The government expects the regulatory framework to boost projects, stimulate innovation, reduce emissions, and strengthen the national hydrogen industry.

Next Steps

Following the publication of the decree, the Ministry of Mines and Energy (MME) will begin the implementation phase of the instruments foreseen in the laws. The ministry emphasizes that this phase will be marked by joint action between the government, the productive sector, and the scientific community, focusing on accelerating the consolidation of the hydrogen economy in the country.
