The MME (Ministry of Mines and Energy) opened, this Friday (23), Public Consultation No. 212 for the formulation of the public policy that will establish general guidelines for the anticipation of contracts for winning projects of the LRCE (Auction of Reserved Capacity in the form of Energy) and the LRCAP (Auction of Reserved Capacity in the form of Power).

The proposal is consolidated in a draft resolution from the CMSE (Electricity Sector Monitoring Committee) and, according to the MME (Ministry of Mines and Energy), seeks to strengthen the security of the SIN (National Interconnected System). What is a public consultation?

Public consultation is a tool used by government authorities to gather suggestions, criticisms, and contributions from society before making a regulatory decision or implementing a public policy. The goal is to broaden social participation, improve the technical quality of regulations, and ensure greater transparency and efficiency in government decisions.

Importance of opening this public consultation.

Roberto Valler, CTO of Huawei Digital Power Brazil for solar energy and battery storage applications, highlights that the initiative can bring significant gains for investors and for the efficiency of the electricity sector.

According to him, contractual anticipation is already foreseen in the current rules, but the process is still bureaucratic. “Today, in capacity reserve auctions, a project that would come online, for example, in 2028, can already request contract anticipation from the CMSE, which assesses whether the system needs this energy before the originally planned deadline. This decision goes through a committee formed by representatives from the MME, EPE, ONS and…” ANEEL"He explains.

According to Valler, early payment can represent a direct benefit to the investor, allowing for a faster start to revenue generation. "In practice, this works as an extension of the contract, as it anticipates the receipt of revenue. It's an important mechanism to provide more predictability and security to projects," he states.

According to the executive, the public consultation aims precisely to improve this process, making it more agile and less bureaucratic. "What I understand is that the government wants to improve this current procedure, simplifying steps and providing more clarity to the rules. That's why they are asking for contributions from society. I think it's a very positive initiative, which could represent an advance in revenue and greater efficiency for the winning projects in the auctions," he concludes.
