Provisional Measure No. 1304/2025, which deals with the reform of the electricity sector, currently being processed in the National Congress, needs to bring concrete solutions to the challenges faced by the solar energy sector in Brazil, assesses the ABSOLAR (Brazilian Photovoltaic Solar Energy Association).
In a note sent to the press, the entity believes it is necessary for the MP to bring predictability and preserve legal certainty in contracts signed by large solar plants and consumers with their own generation, as well as "solve urgent problems," such as renewable generation cuts and the creation of rules to unlock the storage of electricity.
“For the serious problem of cuts, which have significantly impacted companies in the sector, ABSOLAR advocates the incorporation of Amendment No. 9 into the report of Provisional Measure No. 1.304/2025. This amendment establishes an appropriate rule for the reimbursement of renewable power plants.
Currently, due to Resolution ANEEL No. 1.030/2022, the right to compensation was stripped away, resulting in the waste of clean and renewable energy and significant financial losses for agents. The Provisional Measure can provide solutions to this impasse.
Another fundamental measure in the MP is the preservation of legal certainty, with the maintenance of TUSD and TUST discounts for existing and operating plants, thus ensuring legal stability and Brazil's credibility in attracting investments.
In relation to DG (distributed generation), the association understands that it is necessary to preserve the current rules of the legal framework for the modality (Law 14.300/2022), the result of a recent agreement signed between representatives of the electricity sector, ANEEL, the Federal Government and the National Congress.
“For both centralized and distributed renewable generation, the withdrawal of incentives is already planned: for large plants by Law No. 14.120/2021 and for self-generation systems, by Law No. 14.300/2022, whose schedules must be maintained.”
Another topic considered essential by ABSOLAR The MP aims to create a legal framework for electricity storage in Brazil. "This is a new market, capable of providing effective and strategic solutions in the renewable energy sector, in addition to being a major driver of social, economic, and environmental development, generating local green jobs and attracting capital to the country."
A ABSOLAR He also reported that he has maintained dialogue with the National Congress, players in the photovoltaic sector and official bodies in the electricity sector, to “support the development of solutions and improvements in Brazil's sustainable energy transition process.”
