A ANEEL (National Electric Energy Agency) released a report on the adhesion of generation projects to Provisional Measure 1212, published on April 10, 2024. In total, 1,983 plants presented the adhesion term, totaling a power of 85.3 G.W. (gigawatts).

One of the MP's commands aims to extend 36 months the deadline for entry into operation of projects covered by Law No. 14,120/21.

This law put an end to the granting of subsidies to renewable sources, whose main benefit is the 50% discount on energy transport tariffs. According to the rule, projects that filed a grant request 12 months after the publication of the law would guarantee the benefit of the wire, as long as they came into operation within 48 months.

MP 1212 adds another 36 months to this period. The government's objective is to give entrepreneurs more time to develop their projects, aligning generation deadlines with the start of transmission line operations.

According to ANEEL, solar plants lead the requests for deadline postponement, totaling 65.7 GW. Next come wind power, with 19 GW. The 12 thermal plants and two Small Hydroelectric Plants (PCH) together have 654 MW (megawatts).

“The MP requires interested parties to sign a Term of Adhesion, to provide a guarantee of faithful compliance with 5% of the estimated value of the project and for the works to begin within 18 months, counting from the date of issuance of the MP”, explains the agency regulator.
