Deputy Danilo Forte (PP-CE) filed a request on Tuesday (6) that aims to accelerate the processing of PDL No. 2.608/2026, which proposes to suspend the LRCAP (Auction of Reserved Capacity in the form of Power).
The congressman's goal is to ensure that the text is analyzed directly by the plenary of the Chamber of Deputies, without going through the committees.
The movement is increasing political pressure on Congress by attempting to shorten the legislative process and improve the chances of a short-term vote on a proposal that has been generating strong debate in the electricity sector.
Criticism of the auction
Authored by Representative Marcel van Hattem and other parliamentarians, the PDL No. 2.608/2026 This document outlines the main arguments for suspending the LRCAP (Brazilian Logistics and Competition Law). The bill proposes to suspend the regulations issued by the Ministry of Mines and Energy (MME) that established the guidelines and procedures for the bidding process.
Among the central points, the text states that the auction design favors the contracting of fossil fuel thermal power sources, such as natural gas and coal, in addition to hydroelectric expansions, which would lead to a concentration on more polluting sources.
According to the project, this goes against principles of national energy policy, such as environmental protection, incentives for alternative sources, and affordable tariffs.
The PDL also points to the absence of a Regulatory Impact Analysis (RIA), required by current legislation, and argues that the Ministry of Mines and Energy (MME) exceeded its regulatory power by instituting a model without a clear legal basis.
Furthermore, it questions the lack of adequate justification for the need and urgency of the contract awarded in the auction.

The offensive in Congress occurs amidst a broader movement contesting the LRCAP (Brazilian Law on Renewable Energy Production and Supply). Renewable energy associations, consumer advocacy groups, and industrial sectors have criticized the adopted model, pointing to the exclusion of technologies such as batteries, the predominance of fossil fuels, and the significant increase in the price ceiling on the eve of the bidding process.
There are also questions about tariff impacts, since the contracts stipulate payment even without energy dispatch, in addition to high variable costs.
In the institutional field, the debate extended to the TCU (Federal Court of Accounts) and the Judiciary, where requests were made to suspend the auction and questions were raised about its structure, although initial decisions kept the process going.
Risk to the system
Meanwhile, there is a relevant debate in defense of the LRCAP (Large Contracting Regime for Power Supply). Experts and agents in the electricity sector argue that contracting firm power is essential to guarantee the security of the system, especially given the growing participation of intermittent sources in the energy mix.
According to this view, suspending the auction could increase the risk of an energy deficit and compromise the reliability of supply in the medium term.
