Minigeneration will have tax exemption

Investors in distributed minigeneration plants received good news this Wednesday (05). The Ministry of Mines and Energy published Normative Ordinance No. 78 with the conditions for classifying this project category in the REIDI (Special Incentive Regime for Infrastructure Development). 

Once projects are accepted into REID, entrepreneurs will have their PIS (1.65%) and COFINS (7.6%) suspended for up to five years. on the purchase of equipment and other items. 

The publication of ordinance complies with the provisions of art. No. 28 of Law 14,300/2022, known as the legal framework for distributed generation. The article was vetoed by then-president Jair Bolsonaro, but in August 2022 Congress overturned the veto. 

Distributed minigeneration plants are those with power between 75 kW and 5 MW, with the photovoltaic source representing 99% of the projects installed in the country. Water source (CGH), wind and thermal projects are also classified as minigeneration.

It is worth highlighting that Only requests made from the date of publication of the Ordinance will be accepted. Furthermore, the framework will only apply to projects under the ownership of a legal entity. 

The investment limit for REID classification purposes will be R$ 4,000/kW for photovoltaic plants, R$ 5,000/kW for hydro, R$ 4,500/kW for wind and R$ 4,000/kW for thermal.

  1. Can you clarify whether the ordinance applies to customers who use Distributed Solar Energy Generation?

  2. I would like to know why the government doesn't give tax incentives and lower prices for citizens to put clean energy (photovoltaics) in their homes? Everything is very expensive!
