The new replacement text for PL 5829/19 will be published between today (4) and tomorrow (5) with changes to reach a consensus in the Chamber of Deputies. 

The rapporteur of the proposal that creates the Legal Framework for GD (distributed generation), deputy Lafayette de Andrada (Republicanos/MG), also told the Solar Channel that the PL will be put to a vote on Thursday (6).

The decision on the agenda and the wording of the new substitute was taken after a meeting held this Tuesday with the bench leaders to discuss the project.

As reported by the Canal Solar report, the changes that will be made concern the maximum power limit for photovoltaic projects, which will be 3 MW and the transition period which should change from ten to eight years.

Another important change that must be made to the text is about Thread B. The non-compensation portion of Fio B for microgeneration projects (up to 75 kW) for legal entities was reduced, so what was previously 28% becomes 14%.

According to Hewerton Martins, president of MSL (Movimento Solar Livre) the change of paying half of Fio B is positive. “This change responds to a request from Movimento Solar Livre to serve small commercial projects, such as bakeries, butchers and small neighborhood markets, beauty salons, among others. Deputy Beto Pereira presented the proposal to expand access to small and medium-sized businesses that generate jobs in all municipalities in Brazil”, he highlighted.

Lafayette also highlighted that the current rules will be maintained for 25 years. “The current rules will continue to be valid for 25 years in respect of signed contracts, guaranteeing legal security,” said Lafayette.

The deputy also informed that two articles will be added to his new text. The first will determine that ANEEL (National Electric Energy Agency) carries out studies and starts to economically value the benefits of DG in Brazil and the second aims to curb the speculative trade in access opinions.
