Six green agenda projects to move Congress in 2024

Proposals for sustainable agendas are under parliamentary analysis at the beginning of the year

O National Congress returns to activities next Monday (5). With the resumption, parliament also returns to discuss bills, of the so-called “green agenda”, to take the country to a more sustainable future.

Among the themes of these bills are renewable energy, carbon market, environmental licensing, in addition to low greenhouse gas emission fuels.

The CNI (National Confederation of Industry) sees these proposals as crucial for neo-industrialization Brazilian, in addition to stimulating the competitiveness of the economy from the country. These projects are part of what the entity called “Decarbonization”, one of the missions of the political proposal to resume the country’s growth.

What the CNI expects is: new international investments, greater supply of renewable energy sources at a lower cost, reduction of illegal deforestation, implementation of the value chain of alternative energy sources (solar, wind, biogas, low-carbon hydrogen ).

There are already some green agenda projects currently being processed in congress.

Green Hydrogen Legal Framework

At the end of last year, the Senate approved the PL 5.816/2023 which creates the PHBC (Low Carbon Hydrogen Development Program) to encourage the production routes of fuel and derivatives in addition to a legal framework for the sector.

Furthermore, the Chamber approved the PL 2.308/2023 which also establishes a National Low Carbon Emission Hydrogen Policy.

Therefore, it is clear that it is a topic that is already on the radar of both the Chamber and the Senate.

Legal framework for offshore energy use

Another project on the green agenda that establishes a legal framework, in this case of offshore energy use, is the PL 11.247/2018 which has already passed through the Chamber, being approved in November 2023 and returned to the Senate.

The text provides criteria for exploration for the exploration of offshore energy potential, defining the areas in which they can be used and the need or not for authorization or concession in the location. 

Furthermore, it will be compulsory to contract energy from small hydroelectric plants (PCH), wind plants, hydrogen from ethanol, or natural gas thermoelectric plants. Transportation and pipeline construction costs being included in the auction.

According to the CNI, offshore wind farms can increase the country's energy capacity by up to 3.6 times.

Fuel of the future

The PL 4.516/2023, or the Fuel of the Future project, wants to encourage the use of sustainable fuels. Examples are Sustainable Aviation Fuel (SAF), ethanol and green diesel.

The proposal creates two programs, ProBioQAV (National Sustainable Aviation Fuel Program) and the PNDV (National Green Diesel Program). The MME (Ministry of Mines and Energy) hopes to capture up to R$ 200 billion in investments by 2037.

Carbon market regulation

Other approved proposal by the Chamber of Deputies last year. The PL 2.148/2015 is under analysis in the Senate, and creates the SBCE (Brazilian Greenhouse Gas Emissions Trading System). This system stipulates an emissions ceiling, in addition to providing a market for the sale of securities associated with the reduction and emission of these gases.

Sources that emit more than 10 thousand tons of carbon, or equivalent, per year will be regulated.

Accelerating the energy transition

O  Energy Transition Acceleration Program (Paten) is being processed in the Chamber of Deputies, and seeks to make it possible to use taxpayers' tax credits to expand research and infrastructure aimed at sustainable development.

Provided for in the PL 5.174/2023, Paten has as its instrument the BNDES Green Fund, in addition to the possibility for companies to carry out transactions conditioned on investment in sustainable development.

Environmental licensing

PL’s General Environmental Licensing Law 2.159/2021 It is currently being processed by both the Agriculture and Environment committees of the Senate. The project establishes parameters and facilitates the process for environmental licensing.
