Basic text of the substitute for PL 5829 will undergo changes

A new base text for PL 5829/19, which aims to create the legal framework for DG (distributed generation) should be filed in the next few days. The statement was made to Solar Channel by the rapporteur of the proposal, federal deputy Lafayette de Andrada (Republicanos/MG).

“We are making final adjustments and analyzing the amendments, incorporating some of them,” said the parliamentarian. Without going into detail about what these adjustments are, Lafayette denied that major changes will be made.

Carlos Evangelista, president of ABGD (Brazilian Association of Distributed Generation), who is assisting in the development of the text, comments that the changes that must occur in the text aim for a consensus among entities in the electricity sector. 

“The objective from the beginning was to create a consensus PL. We tried to include in the proposal the expectations of each of the associations that work with distributed generation and this final part was trying to find a consensus text that would also meet the demands of the associations that did not agree with us”.

“We are studying possibilities for improvements and changes that do not change the main structure of the text, however, they make a big difference for other associations that have a different view of GD.”, adds Evangelista.

Chamber Agenda

Another move this week was the agreement made between Chamber leaders to focus on projects to combat the pandemic for the next 15 days. According to the president of the Chamber of Deputies, Arthur Lira (PP/AL), topics unrelated to the pandemic will be paused for two weeks. Read the statement.

According to lawyer Bárbara Rubim, vice-president of Distributed Generation at ABSOLAR (), the decision by the Chamber leaders is not surprising. “It is not a surprise, especially given the worsening we have had in recent days in relation to the pandemic numbers, and this obviously impacts not only 5829, but all other projects that are in progress”.

She also highlights that since the pandemic began, the country has not experienced a normal scenario and this also affects the National Congress. “Now in March, Congress returned to operating remotely, with limited entry and circulation, and this impacts voting in many ways, not only in the rite of voting but also in the articulation for voting on projects”, he highlights.

The lawyer also comments that the PL has attracted interest from different parties. “5829 is a project that has caught the attention of society and the National Congress and, obviously, economic groups that oppose its approval, at least as it stands today.”

“But, at first, our reading is that the project was unable to enter an effective agenda for a Plenary vote, rather due to the pandemic issue than due to an action by these groups. In any case, to mitigate either of these two consequences, the sector has worked hard to ensure broad support from deputies and senators for 5829, especially a public demonstration of support, which is very important”, he concludes.
