The Federal Regional Court of the 1st Region (TRF-1) accepted the government's request and decided this Friday (21) to overturn the decision that had removed the current directors of ANEEL (National Electric Energy Agency) and ONS for 30 days. (National System Operator).
The removal had been determined on Thursday (19) by the federal judge of Amapá, João Bosco Costa. However, the president of TRF-1, Ítalo Mendes, accepted the appeals of the Attorney General's Office (AGU) which requested the directors' return to their positions.
In the decision, Mendes said that the federal judge exceeded the powers of his position and ended up interfering in the structure of the organization of the federal public administration and in the regular performance of its functions, harming the continuity of the actions to be adopted by the aforementioned agents in the context of management, and which could impact measures to normalize energy supply in Amapá.
Senator Randolfe Rodrigues (REDE), author of the popular action that called for the directors to be removed, regretted the TRF-1's decision since, in his opinion, the bodies were silent. “On April 7th there was a communication from the concessionaire itself to ANEEL, saying that due to the pandemic it would not have technical conditions, and ONS and ANEEL did nothing, they were silent.”
