Open letter supports extension of the deadline for compliance with Law 14,300

Seven associations released, this Monday (7), an open letter to Brazilian society that aims to extend the deadline for compliance with the rules set out in Law 14,300, which establishes the Legal Framework for micro and mini energy generation.

The law gave ANEEL (National Electric Energy Agency) a period of up to 10 days, counting from the date of its publication, to regulate the application of Law 14,300 for concessionaires and licensees for the distribution of electricity with concession contracts in Brazil. .

As a result, the associations suggest that the regulatory period be extended. As justification, the seven entities present topics to justify this request, such as the delays of energy concessionaires and the difficulties faced by consumers.

According to the note, due to ANEEL's delay, the electric energy distribution concessionaires and licensees also did not update their internal regulations in accordance with the law and have still failed to apply provisions of the aforementioned law, which do not even depend on the regulation.

All these actions, according to the associations, cause harm, especially to consumers interested in renewable distributed generation.

“It has become essential to adapt Law No. 14,300/2022, in defense of justice, balance and coherence, in order to provide the necessary predictability, stability, legal security and regulatory security for renewable distributed generation in Brazil. Therefore, the signatory associations of this open letter fully support Bill 2703/2022 authored by Federal Deputy Celso Russomanno”, stated the letter.

As disclosed in the document, this and other problems were exhaustively reported by consumers, entrepreneurs and sector entities.

“In various media (these obstacles were exposed), via official letters, as well as with the responsible authorities, such as the Public Hearing held at the Consumer Protection Committee of the Chamber of Deputies, on June 22, 2022”, added the document.

The letter was signed by Abrapa (Brazilian Association of Cotton Producers), ABSOLAR (Brazilian Association of Photovoltaic Solar Energy), ABGD (Brazilian Association of Distributed Generation), Abramilho (Brazilian Association of Corn Producers), Sebrae (Brazilian Support Service to Micro and Small Businesses), FBHA (Brazilian Federation of Accommodation and Food) and the Movimento Solar Livre.
