Lafayette will present PL that creates a legal framework for the Electrical Sector and GD

Federal deputy Lafayette de Andrada (Republicanos/MG) will present, next Friday (31), the text that aims to establish the legal framework for distributed generation in the country. The proposal will be presented through the report on the CBEE (Brazilian Electric Energy Code), of which the parliamentarian is the rapporteur.

The PL, which aims to review all electricity sector legislation, will be presented at 10 am during a virtual meeting of the special commission that discusses the CBEE, formed in August 2019.

“In our report, we deal with the generation, transmission and distribution of energy in Brazil. The idea is to untie the series of rules that the sector has, providing legal certainty for investors”, says the deputy.

Lawyer Marina Meyer, legal director of ABGD (Brazilian Association of Distributed Generation), highlights the importance of this bill. “This is a successful project because all Energy Law issues, including distributed generation, will be dealt with within a federal law.”

With the approval of this project, after processing in the Chamber of Deputies and the Senate, a new legal framework will be established in the country, ceasing discussions on REN 482. “The CBEE will cover all ANEEL (National Electric Energy Agency) resolutions. ), including REN 482. With this, distributed generation will be treated within the Brazilian Electric Energy Code, which is valid for all states in Brazil. This step will be extremely important for the sector to have more legal security and be treated in a uniform manner throughout the country”.

To prepare the document, Lafayette participated in several debates and virtual meetings with the electricity sector during the pandemic, listening to all segments involved: hydroelectric, wind, solar, nuclear, biomass, PCHs, distribution, transmission, among others.

Proposal must be voted on in August

A PL vote should be held next month, as stated by Deputy Lafayette during the closing of the online GD Forum, promoted by ABGD.

At the time, the parliamentarian highlighted that the proposal had not yet been presented due to the Covid-19 pandemic, which was the focus of the Legislature. “I have not yet filed the bill, which proposes a new regulation for the GD, because we think it is much more feasible and feasible to present it as a replacement amendment in a PL that is already being processed in the House. That's what we agreed with the President of the Chamber. Furthermore, the Legislature is prioritizing the progress of projects that are directly related to the Covid-19 crisis”, explained Andrada.

The deputy's statement received Marina's support. “The bill will be integrated into the Brazilian Electric Energy Code, which is being created, and will fulfill the role that today belongs to Normative Resolution 482”.
