The deputies of AL-MT (Legislative Assembly of Mato Grosso) approved, last Wednesday (11), the Bill 897/2021, which definitively vetoes the collection of ICMS (Tax on the Circulation of Goods and Services) on solar energy generation systems in the State.
The text – authored by state deputy Faissal Calil (Citizenship) – will now go to governor Mauro Mendes (União Brasil) for sanction.
In the vote, the deputies unanimously understood that there is no triggering event in the “loan” of energy made by the user who owns a solar energy plant, since the consumer only uses a resource that he himself produced.
According to Faissal, it is “impossible to charge any tax, as there is no circulation of goods and you are consuming your own product. This is, in fact, the Court's understanding of the matter (know more)”, he highlighted.
GD solar in Mato Grosso
According to data from ANEEL (National Electric Energy Agency), updated this Monday morning (16), the state of Mato Grosso is the fourth in the country with the highest number of solar energy systems installed in the DG (distributed generation) segment.
In the locality, there are already 51.9 thousand photovoltaic plants connected to the distribution network, behind only São Paulo (163.2 thousand), Minas Gerais (157.3 thousand) and Rio Grande do Sul (132.9 thousand).
According to ANEEL, all 141 municipalities in Mato Grosso have at least one system installed in their respective cities. In total, the State has an installed capacity in solar DG of 715.6 MW.
