Minas Gerais renews ICMS exemption for solar energy until 2032

O Government of Minas Gerais informed that it renewed the ICMS exemption (Tax on Circulation of Goods and Services) for the solar energy for another ten years, until December 31, 2032.

In the case of G.D. (distributed generation), the energy compensated by consumer units – that which returns to offset credits – continues to be exempt from tax for projects of up to 5 MW. 

A measure includes the modalities of shared generation and isenterprises with multiple consumer units. The exemption was scheduled to end in the State on December 31st of this year. 

In the other states of Brazil, with the exception of Rio de Janeiro and Espírito Santo, which follow the same rules as Minas Gerais, the limit for exemption from ICMS is only for plants with up to 1 MW and for generation projects with the same ownership.

The state of Minas Gerais also extended for the same period (ten years) the ICMS exemption for electrical energy produced in generating plants for sources other than solar, wind, biogas, biomass and hydraulic. It is also worth mentioning that from 2029 onwards, these benefits will be reduced by 20% per year, as foreseen in the ICMS 68 Agreement /2022. 

Minas Gerais

Currently, Minas Gerais has around 2.07 GW of photovoltaic solar energy in operation in homes, commerce, industries, rural properties and public buildings. 

The State has the largest installed power in all of Brazil, with all of its 853 cities having at least one installation, according to data from ANEEL (National Electric Energy Agency).

In total, the municipalities of Minas Gerais have more than 247.6 thousand UCs receiving credits and more than 185.8 thousand photovoltaic plants installed in all 853 cities that make up the state.
