Energy trading rules for 2024 enter public consultation

A ANEEL (National Electric Energy Agency) determined, this Tuesday (03), the opening of the Public Consultation No. 37/2023 for suggestions to Rules in Commercialization in Electricity which will come into force on 2024.

The proposal was sent by the CCEE (Electric Energy Commercialization Chamber) and analyzed by the ANEEL technical team, with the addition of improvements. The consultation opened this Wednesday (04) and will continue until November 17th.

Among the changes planned in relation to the current rules are:

  • The inclusion of LEN (New Energy Auctions) and LEE (Existing Energy Auctions) contracts that begin supply in the years 2024, 2025 and 2026;
  • The adequacy of the Rules to the definitions of dispatch modalities present in the ONS (National Electric System Operator) Network Procedures;
  • Limiting the registration of contracts for suppliers classified as Type 2, who will have their contracts limited to the amount of 30 MWmed;
  • The reformulation of energy allocation from the ACL (Free Contracting Environment) to the ACR (Regulated Contracting Environment), which will follow a concept similar to the transfer of reserve energy, in which additional allocation occurs only when there is an effective need to avoid a reimbursement. It is also proposed that the declaration of the mechanism occurs before the beginning of the contractual year. The validity of the mechanism begins in 2024, with declaration of participation still in 2023;
  • The reformulation of the Proinfa energy quota definition process, which will now be automated based on monthly load information from agents.

During the consultation, the Agency stated that the CCEE's proposal for adjustments in the seasonality of physical guarantee of electricity generation plants for ballast purposes will not be addressed. According to the vote of Agnes da Costa, director-rapporteur of the process, the regulatory issue will be addressed in a specific process.
