A ANEEL (National Electric Energy Agency) is scheduled to analyze, next Tuesday (21), the process that regulates the extension, for 20 years, of the contracts of plants participating in Proinfa (Program to Encourage Alternative Sources of Electric Energy). The vote is on the agenda of the agency's deliberative circuit.
The contract extension is provided for in Law No. 14.182/2021, known as the Eletrobras Privatization Law, and in Decree No. 10.798/2021, conditional upon the removal of discounts on transmission and distribution system usage tariffs.
Created on April 26, 2002 by Law No. 10.438, Proinfa aims to expand the participation of wind, biomass and small hydroelectric power plants (PCHs) in the National Interconnected System.
The legislation allows for the extension of power purchase agreements for an additional 20 years for agents who expressed their agreement by July 7, 2025. The extension will be counted from the original expiration date of each contract.
To assume the responsibilities previously held by Eletrobras, ENBPar (Empresa Brasileira de Participações em Energia Nuclear e Binacional) was created, a public company linked to the Ministry of Mines and Energy that will be responsible for managing the new contracts.
In total, 83 power plants expressed interest in the renewal. The regulation also includes the renegotiation of hydrological risk for hydroelectric plants participating in the MRE (Energy Relocation Mechanism). Furthermore, it allows for a future, costly extension of the concessions for hydroelectric projects with a capacity greater than 5 MW and equal to or less than 50 MW.
Since the contracts have different expiration dates, the new terms should extend to periods between 2046 and 2051.
