The expectation of professionals and businesspeople who work in the ACL (Free Contracting Environment) – known as the Free Energy Market – is that the contracts signed will be able to remain within the current market rules.
This was the main point raised in the panel “PL 414 and the modernization of the sector: the challenges and opportunities with self-production”, moderated by Raphael Gomes, Partner and Head of the energy area at Lefosse, during Lefosse Energy Day.
In the opinion of Bruno Uchino, from the Unipar Group, PL 414/21 is very important for the sector and must be addressed by Congress and must respect the negotiations already carried out. “The legislation will change, but I believe that the projects already contracted will respect the dynamics of the benefits already contracted in a very transparent way”.
“What we are very confident in is that the sector will continue to be in a solid position of respect for projects carried out under current regulations. New projects will change, legislation will change, but we do believe that the projects already contracted will respect the current dynamics and be respectful of everything that was contracted”, added Uchino.
He also highlighted the role of self-production in the electricity sector. “One thing is undeniable: self-production has played the role of bringing a lot of capacity to the system in recent years, it has been a driver for connecting new capacity.”
Elisa Pascoal, Head of M&A at Casa dos Ventos, also trusts that the new law will respect the contracts already signed. “We can only trust that the law considers the protection of negotiations and contracts signed with current law,” she said.
According to her, Casa dos Ventos is accelerating the progress of the planned installations and is talking to customers to explain the possible scenarios, since most customers do not have an internal energy team that is monitoring the issue.
Alexandre Viana, from Thymos Energia, pointed out that with the expectation of a new law, since March self-production consumers have accelerated the contracting process. He also believes that this segment will continue to exist, but with significant changes.
“Self-production will not end, just that there will be stricter rules. Therefore, some current models under new regulations will become less attractive. What we say is: given the rules in place, it is time to accelerate to comply with this process, if possible, this year,” he stated.
