The TCU (Federal Court of Auditors) determined that the ANEEL (National Electric Energy Agency) to present a detailed report on ENEL-SP's energy supply failures. The order, signed by Minister Augusto Nardes, also warns of the risks of an early renewal of the company's concession, which is valid until 2028.
The decision was prompted by a complaint filed by the Public Prosecutor's Office with the Federal Audit Court (TCU), which found "strong evidence of inadequate service provision" by the utility company. Blackouts between 2023 and 2024 left more than 3,1 million properties without power and caused R$1,65 billion in losses to businesses, according to Fecomércio-SP.
The TCU demands that the ANEEL Report any irregularities already identified, any sanctions applied, and the current status of the investigation. According to Nardes, the regulatory agency's actions should ensure the continuity of quality service and, if necessary, consider alternatives such as a new bidding process.
ENEL-SP requested a 30-year contract renewal, but the TCU (Federal Audit Court) considers the proposal "incompatible with the recent history of failures." The minister emphasizes that any extension must be "adequately justified technically and economically."
The Federal Court also suspended the early renewal process, granting a request from the City of São Paulo. The judge pointed to supply failures, million-dollar fines, and a lack of transparency. ANEEL.
The TCU forwarded a copy of the decision to the state government and the São Paulo City Hall, demanding support for actions to mitigate the social impacts of the blackouts. ANEEL has not yet made a public statement about the ruling.
