The board of ANEEL (National Electric Energy Agency) is expected to analyze, this Tuesday (12), a draft vote that proposes to extend for another 60 days the suspension of reimbursements applicable to wind and photovoltaic plants contracted in the ACR (Regulated Contracting Environment) in the availability modality and in the Reserve Energy Contracting.
The proposal was presented as part of a request for precautionary measures filed by Abeeólica (Brazilian Wind Energy Association) and by ABSOLAR (Brazilian Solar Energy Association).
On April 9th, the associations requested that the suspension be maintained while discussions progress on the regulation of renewable energy generation cuts and the criteria for financial compensation foreseen in the legislation.
According to the rapporteur of the process, director Willamy Moreira Frota, the extension seeks to avoid financial impacts before the conclusion of the regulations related to the topic, especially in light of the discussions involving the constrained-off.
"I understand that this timeframe is sufficient for the completion of the work by the Ministry of Mines and Energy, aiming for the expected resolution of the issue within the sector," the rapporteur assessed.
The document mentions that the suspension of constrained-off recalculations had already been adopted by CCEE (Chamber of Electric Energy Commercialization) following guidance from MME (Ministry of Mines and Energy), amidst regulatory discussions stemming from Law No. 15.269/2025.
The draft also highlights that the amounts involved will depend on the generators' adherence to a Commitment Agreement with the Ministry of Mines and Energy (MME), a mechanism that seeks to end legal disputes related to the topic and bring greater regulatory certainty to the sector.
According to the draft, these amounts will also depend on these generators adhering to the Commitment Agreement that must be signed with the Granting Authority, a legal instrument signed (individually) by each generator with the Ministry of Mines and Energy (MME), aiming to end legal disputes on the subject, while providing legal and regulatory security and stability to the sector.
