ANEEL must publish a proposal to regulate Law 14.300

Article 30 of the Law established a deadline of 180 days for the Agency to adapt its regulations

With a delay of more than 60 days ANEEL (National Electric Energy Agency) must finally publish a technical note to regulate Law 14.300/2022, which created the Legal Framework for DG (distributed generation).

According to sources heard by the Canal Solar This technical note aims to present a proposal, to be submitted to Public Consultation, regarding the adaptation of the regulations applicable to micro and mini distributed generation, currently established by Normative Resolutions 482/2012 and 1.000/2021, in addition to Section 3.1 of Module 3 of PRODIST (Distribution Procedures).

It is important to highlight that article 30 of Law 14.300/2022 established a period of 180 days, counted from its publication, for the ANEEL adapt its regulations. And for this reason, it will be necessary to redo a normative proposal considering the legislative update, according to the deadline of the Law.

This deadline expired on July 7, 2022, as Law 14.300 was published in the DOU (Official Gazette of the Union) on January 7, 2022.

When asked about the opening of the Public Consultation, the ANEEL stated that 'a new consultation on the topic has not yet been opened and that its opening is approved at a meeting of the Agency's board of directors'.

During live this Thursday (8), INEL (National Institute of Clean Energy) addresses the topic and discusses the regulation of DG (distributed generation). Participating in the live broadcast are Professor José Wanderley Marangon, INEL's Regulatory and Tariff Secretary, Marina Meyer Falcão, INEL's Legal Director, and Ricardo Costa, Secretary of Solar Energy.

According to the institute, the draft will still be discussed by the directors of ANEEL to then become public. In addition, INEL reported that the topic will be reported by director Hélvio Neves Guerra.
