Five renewable energy incentive projects that could become law in 2026.

The proposals are currently at different stages of analysis within the National Congress.

The prominence of renewable energies in the Brazilian electricity matrix has driven not only new investments, but also advances in the regulatory and legislative fields, with agendas increasingly focused on social impact and the energy transition.

Currently, several bills dealing with incentives for clean energy sources are being processed in the Chamber of Deputies. The proposals are at different stages of analysis and could become law in the coming months if they advance through the legislative process.

Below are five of these projects currently under consideration:

Incentives for the use of renewables in new constructions

  • 2741 / 2024 Bill

The project includes incentives for the installation of renewable energy sources, such as photovoltaic systems, in new buildings, as well as granting discounts on urban planning fees for developments that adopt green roofs.

The proposal also amends the City Statute, guiding municipalities to create local policies to encourage the generation of clean and renewable energy in buildings.

Current situation: The text was approved by the Urban Development Committee in December 2025 and then sent to the Constitution, Justice and Citizenship Committee for analysis.

"Green Passport" program for companies

  • 1338 / 2025 Bill

The proposal creates the "Green Passport" program, which grants tax benefits to companies that prove they exclusively use renewable energy in their operations. The goal is to encourage the adoption of clean energy sources in the productive sector.

To that end, the project establishes technical certification criteria and provides for monitoring mechanisms by the public authorities. The text considers the following as clean energy: solar, wind, biomass, geothermal, and small hydroelectric plants or plants with low environmental impact.

Current situation: The proposal is being processed in a conclusive manner and will be analyzed by the committees on Mines and Energy; Environment and Sustainable Development; Finance and Taxation; and Constitution, Justice and Citizenship.

Reverse logistics and recycling of photovoltaic panels

  • 998 / 2024 Bill

The proposal establishes a Policy to Encourage the Development of Reverse Logistics for Photovoltaic Panels, setting guidelines for the reuse, recycling, and environmentally sound disposal of solar modules at the end of their useful life.

The text aims to structure a national recycling chain for photovoltaic equipment, reducing environmental impacts, stimulating the circular economy, and fostering the technological development of the sector.

Current situation: The bill is being processed in a conclusive manner by the permanent committees of the Chamber of Deputies, and is currently awaiting the appointment of a rapporteur in the Committee on Environment and Sustainable Development.

Incentives for the use of renewable energy in irrigation projects.

  • 4790 / 2025 Bill

The project proposes incentives for the use of renewable energy sources, especially photovoltaic solar, in agricultural irrigation systems, with the aim of reducing operational costs in the field, increasing energy efficiency, and promoting sustainable practices in the agricultural sector.

The proposal aims to modernize rural infrastructure, promoting greater economic competitiveness for producers, as well as reducing dependence on fossil fuels and decreasing the environmental impact of agricultural activity.

Current situation: The text is currently being processed by the Mines and Energy Committee.

Tax incentives for micro and mini distributed generation.

  • 752 / 2024 Bill

The text authorizes the deduction in the IRPF (Individual Income Tax) of expenses related to the acquisition and installation of electricity generation systems from renewable sources, especially photovoltaic solar, in residential properties.

The proposal aims to stimulate solar distributed generation in the residential segment, reduce the payback period for installed systems, and increase the economic attractiveness of the technology for individuals.

Current situation: It was approved by the CME and is awaiting the appointment of a rapporteur in the Finance and Taxation Committee.
