The Minister of Mines and Energy, Alexandre Silveira, expressed concern again with ANEEL (National Electric Energy Agency) in relation to the process of transferring corporate control of the distributor Amazonas Energia to Âmbar Energia.
Last Tuesday (8), Silveira spoke with journalists after the sanctioning ceremony of the Fuel of the Future Program. “Very objectively, what we can see is that, if this is not resolved in the best way, and the best way that will be indicated is ANEEL, we could have an energy collapse there, we could have a supply problem.”
Amazonas Energia, which serves around 1,1 million consumers, covers the entire state of Amazonas, including the capital, Manaus, and remote areas of the Amazon.
On Monday (7), the ANEEL published Order No. 3.025, authorizing the sale of Amazonas Energia to Âmbar, in compliance with a court decision by the Amazonas Court.
The agreement generates a cost of R$14 billion, which will be passed on to energy consumers throughout the country over 15 years, a higher amount than the R$8 billion initially suggested by ANEEL. In addition, Âmbar will be required to make a capital contribution of R$6,5 billion by December of this year.
The Director-General of ANEEL, Sandoval Feitosa, said the agency was forced to approve the company's plan so as not to violate the court order. However, he stressed that the measure could be revoked if the court order is overturned.
This Wednesday (9), the G1 reported that Âmbar Energia refused to sign the control transfer contract, the deadline for which ended at 12:XNUMX pm today. The company stated that it will only conclude the deal after an administrative decision by the ANEEL that guarantees the legal security of the process.
“In theory, in a concrete fact, if a court decision determines the signing of a contract, that contract is signed, and that decision is annulled, that entire signature is annulled,” the company declared in a note to G1.
ANEEL postpones vote on request to reconsider transfer of Amazonas Energia
A Ambar filed an administrative appeal against the decision of the director of ANEEL, Fernando Mosna, which had completed the transfer process within the agency. An extraordinary meeting of the board of directors of the ANEEL may be scheduled later this week to discuss the matter.
