PL excludes incidence of tariff flag for solar DG

Proposal inserts the measure into Law 14.300, which created the legal framework for distributed micro and minigeneration

PL 918/22 (Bill 918/2022) is being processed in the Chamber of Deputies, which aims to exempt the cost of tariff flag consumers who produce their own energy from wind or solar sources in DG (distributed generation) systems.

A The proposal is from deputy AJ Albuquerque (PP-CE). The text creates a single paragraph of Article 19 of the 14.300 Law, excluding the incidence of increases through the tariff flag for the consumption of active electrical energy to be billed to consumer-generators of energy through microgeneration and minigeneration distributed through wind or solar sources.

Currently, Law 14.300 allows the incidence of tariff flags on consumption billed in the month. However, Albuquerque argues that this rule is “absurd”.

“These arrays [eolian and solar] are not subject to variations due to water scarcity nor do they require interventions through thermoelectric plants. They constitute low-cost renewable sources of generation that are borne through private investments by consumer-generators”, said the deputy.

The project will be analyzed conclusively – a procedure by which the project does not need to be voted on by the Plenary, only by the committees designated to analyze it. The designated committees are Consumer Protection; Mines and Energy; and that of Constitution and Justice and Citizenship (CCJ).

Excellent measure but in Brazil with corruption it will not be approved.

Congratulations to the deputy! Another measure could review the ICMS on the energy produced by Photovoltaic Panels, which here in Rio is absurd.

We need the support of the State Deputies of RJ, to exempt us or reduce the ICMS charge on energy consumption, because if I had to invest to help the country and my state in energy production, it is not fair that we are taxed around 32%, as we normally produce more than we consume, we made efforts as it will take me 8 years to pay off a loan.

It is also necessary, if prosumers change the location of their plant, in which case next year they will lose all the benefits they have today.

Excellent measure. Very welcome, prosumers are grateful.

CHARGING TARIFF FLAGS IS UNFAIR, BECAUSE THOSE WHO HAVE SOLAR ENERGY ARE ALREADY CONTRIBUTING TO THE ECONOMY.
WE ARE ALREADY CHARGED IN A CERTAIN WAY, AS THERE ARE CHARGES ON TOP OF CONSUMPTION WHICH ARE THEN CREDITED BELOW, BUT WITH A VALUE ALWAYS LOWER THAN THE CHARGE.
IN ADDITION TO WHAT WE HAVE ALREADY BOUGHT 50 KWh (IN THE CASE OF TWO-PHASE), WHICH WE CANNOT TRANSFER TO OTHER ACCOUNTS, KNOWING THAT WE WILL DIFFICULTLY CONSUME IT AT HEADQUARTERS.
