The board of ANEEL approved, this Tuesday (9), the result of the 3rd phase of Public Consultation No. 61/2021, which deals with the improvement of energy commercialization rules. The agenda includes the contracting of the generation capacity reserve, defined by the Granting Authority to guarantee supply to the SIN (National Interconnected System).

Based on Decree No. 10.707/2021, the Agency now regulates aspects such as the allocation of capacity reserve costs, penalties for default, and the creation of the ERCAP (Power Charge). The CCEE (Electric Energy Trading Chamber) will also be responsible for structuring and managing the CONCAP (Power Account) and COPCAP (Power Use Contract).

Modules 16 and 27 of the Marketing Procedures, which address revenue adjustments and reserve contracting, were approved. The CCEE must also publicly justify the monthly percentages applied to establish the guarantee funds for this purpose.

In all, the public consultation received 16 contributions from nine industry stakeholders. Four suggestions were accepted, two were partially accepted, five were rejected, and another five were considered already covered by existing regulations.

“This improvement is essential to ensure supply security and transparency in costs passed on to consumers,” said the ANEEL during the public meeting.
