A Joint Technical Note No. 10/2026 da ANEEL (National Electric Energy Agency), published last Thursday (23), represents an important advance in the schedule of the first Reserve Capacity Auction in the form of Storage (LRCAP-BESS).

For ABSAE (Brazilian Association of Energy Storage Solutions), the opening of the public consultation on the tender and contract next Tuesday (28) brings security for the conclusion of the rules by the Agency.

The association also positively assesses the fact that several points discussed over the past few months with industry stakeholders have been incorporated into the regulatory proposal. These include measures that increase competitiveness among local BESS suppliers and clarifications regarding the granting and deadlines for environmental licensing.

Among the contributions incorporated into the proposal is the flexibility related to local content. Aneel (Brazilian Electricity Regulatory Agency) made explicit the possibility of updating the manufacturer indicated in the registration to another effectively accredited with BNDES (Brazilian Development Bank), provided that the criteria required for proving local content are maintained.

According to ABSAE, the measure increases competitiveness among suppliers, reduces risks for entrepreneurs, and preserves the objectives of the national supply chain development policy.

Other points will be further explored and discussed with members in response to the Public Consultation. For example, the need to accelerate the timeline for issuing the concession and contract stands out, so that the projects are operational by August 2028, adding security to the electrical system.

On the other hand, the Agency's preliminary position of registering generators as contractors of the capacity reserve and requiring the signing of contracts and the provision of guarantees by 2027, even without regulation of the matter by the Authority, poses risks to generators, consumers, and the auction.

In the first LRCAP in 2021, there was no similar requirement by Aneel, partly because the allocation of the charge had not yet been regulated. For ABSAE, the Note reinforces the urgency of approving Bill 3.716/2026, aiming to normalize the cost rules of this auction.

However, the executive emphasizes that "attention must be paid to three key areas: equality among stakeholders; acceleration of project implementation schedules; legal uncertainty and rationality in cost allocation – equal services should be treated equally," he points out.
