The board of ANEEL (National Electric Energy Agency) has not reached a consensus on the extension of the electricity distribution concession contract of EDP Espírito Santo. The lack of definition tends to cause many doubts in the market, since other concessionaires are also waiting for the same decision on maintaining the current contracts.
At the meeting held on Tuesday (22), the 13th of the year, the regulatory agency's leadership spent almost two hours discussing a vote submitted by director Fernando Mosna. Some points raised by him were not well received, especially by the rapporteur of the original process, director Ludimila Silva. At the end of the debate, director Ricardo Tili made a new request for a review, which was accepted – and which once again postpones the decision.
The case involving EDP Espírito Santo is the first in a line of 19 other requests for extension of electricity distribution concessions. The lack of a clear position from the company's board of directors ANEEL This ends up bringing uncertainty, with the understandings having to go through the agency's Attorney's Office or other departments, without a set rule.
The tendency is that these concession renewals will take a long time to be included in the agenda, at least until the current process is concluded. According to decree 12.068, of June 20, 2024, signed by President Lula and the Minister of Mines and Energy, Alexandre Silveira, electricity concessions that have not been extended may be extended for a period of 30 years.
Among the required points is the provision of adequate service, since federal law establishes the fulfillment of quality and efficiency goals in the restoration of the service with stricter criteria, in an egalitarian manner throughout the concession area, for the benefit of electricity users. ANEEL, it is responsible for verifying these services relating to the efficiency of the continuity of supply and economic-financial management.
