Two months later, the board of directors of ANEEL The Brazilian Electric Energy Agency (Agência Nacional de Energia Elétrica) (National Electric Energy Agency) concluded its vote in favor of the distributor Enel-RJ. By majority vote, the board recommended to the Ministry of Mines and Energy (MME) that the company's concession be extended with early effect, in addition to submitting the draft of the eighth amendment to the agreement.

The process had been reported by then-acting director Ludimila Silva, who left the regulator in July. She had already suggested the extension and was supported by the vote of director Agnes Costa.

At the time, however, director Fernando Mosna requested to review the case and the process was removed from the agenda, only returning at the meeting on Tuesday (19). Although Ludimila is no longer part of the regulatory agency's leadership, her vote was maintained, which meant that the substitute director Ivo Sechi Nazareno, who took office in July, did not participate in the conclusion of the vote.

Mosna presented a dissenting vote, in the sense of not recommending the extension of the contact, alleging that the distributor “did not meet the premises of the complementary analysis on the adequate provision of the service”.

Despite this, he considered that the efficiency criteria for the continuity of supply and economic and financial management were met, and that fiscal, labor, and sectoral regularity, as well as legal, economic, financial, and technical qualifications, were proven. He was defeated in the vote.

O distribution concession contract of Enel Rio dates back to 1996. The company serves 2,7 million consumer units in 66 municipalities in Rio de Janeiro.
