O MME (Ministry of Mines and Energy) published, this Friday (30), the 690 / 2022 Ordinance, which puts out for public consultation the draft ordinance that deals with the reduction of the load limit for contracting electricity in the Free Market by low voltage consumers.
According to the MME proposal, as of January 1, 2026, consumers served at low voltage, with the exception of those in the residential and rural classes, will be able to choose to purchase electricity from any concessionaire, permit holder or authorized electricity provider of the SIN (National Interconnected System).
Contributions from interested parties will be received by the federal agency for a period of thirty days, counting from the date of publication of this ordinance, that is, until November 1st. For more details on Public Consultation 137/2022 click here.
According to Pasta, the opening provides “autonomy to the consumer”, as they will be able to choose products that best meet their consumption profile, such as the times when they need to consume more energy.
“In addition, competition tends to provide more interesting prices, improving the efficiency of the economy, being an inevitable and essential measure for the modernization of the Brazilian electricity sector”, pointed out the MME.

The Ministry also highlighted that it recognizes that some related topics still require regulation and improvements, such as: review of portfolio management mechanisms and dismissal of distributors, improvements to retail sales and separation of wire and energy activities.
In view of this, the MME believes that defining the dates for the total opening of the free market in the country will help guide the next steps for the evolution of the Brazilian electricity sector.
“The proposed ordinance submitted for public consultation defines a schedule compatible with the need for regulation, so that there is sufficient time to discuss and fill regulatory gaps and necessary improvements.”
