PL 5829 is off the agenda and should be voted on next week

According to the agenda released by the Chamber of Deputies, the proposal will not be discussed this week

PL 5829 (Bill no. 5829/2019) will not be discussed this Tuesday (27) in the Chamber of Deputies. THE The agenda for the deliberative session was announced this morning and the proposal that creates the GD Legal Framework is not among the texts that will be discussed.

Ao Canal Solar, the bill’s rapporteur, Congressman Lafayette de Andrada, reported that the proposal should be voted on next week. “I thought it would be prudent to leave it for next week, since a new amendment will be released between today and tomorrow. This way, Congressmen and professionals in the electricity sector will have time to familiarize themselves with the new text,” he said.

When asked about what changes will be made, Lafayette said that they will be minor changes, nothing that will impact the text. However, he did not detail what modifications will be made. The congressman also highlighted that he has been meeting with the main groups individually to explain and clarify the main objectives of the proposal for the Brazilian electricity sector.

Public opinion

The Brazilian population has been following the progress of PL 5829 in the Chamber of Deputies. In poll opened by the Legislature, thousands of Brazilians have expressed their opinions on the proposal. As of 9 am this Tuesday, 78% fully agreed with the text, 19% were completely against the project, 2% agreed with the document for the most part and 1% disagreed for the most part. The number of undecided voters represented, statistically, around zero percent of the total choices.

What does the GD Legal Framework provide?

The amendment presented by Congressman Lafayette de Andrada proposes gradual payment by consumers with distributed generation for the use of electrical infrastructure, through the so-called TUSD fio B of distributors and concessionaires. Additionally, the text establishes a ten-year transition period for the change in the regime in relation to the current model, in line with the guidelines of the National Energy Policy Council.

The changes would come into effect 12 months after the publication of the Law and ensure that the current rules are maintained for pioneering consumers, bringing more legal and regulatory certainty to consumers who generate their own renewable electricity. For generation systems close to the load, shared generation, EMUC, self-consumption up to 500 kW and dispatchable renewable sources, there will be a gradual payment schedule for TUSD Fio B that increases from 0% in 2022 to 100% in 2033.
