Os Existing Energy Auctions A-1 and A-2, the only generation confirmed by ANEEL (National Electric Energy Agency) for 2023 to date, have been defined for December 1st.

This Wednesday (19), the Agency opened Public Consultation No. 24/2023, to receive suggestions for the notice and its annexes. The competitions, aimed at contracting energy from plants already built, will be promoted by the CCEE (Electric Energy Trading Chamber) through an online platform.

According to ANEEL, the CCEAR (Electric Energy Commercialization Contracts in the Regulated Environment) to be negotiated will be in the quantity modality, with energy coming from any source and also that offered by electricity traders.

The contracts will be valid for two years, starting on 01/01/2024, for Auction A-1, and from 01/01/2025, for Auction A-2. The costs arising from hydrological risks will be assumed by the seller and there will be no update to the price of contracted electricity during the validity of the CCEARs.

Distribution agents must submit their declarations of need from 21/08 until 04/09/2023. The auction guidelines and systematics, as well as the CCEARS drafts, follow the instructions in the 1 Auctions A-2 and A-2022 notice.

“The proposed changes are mostly due to adaptations for the adoption of the new Law on Public Tenders and Administrative Contracts (Law No. 14.133/2021) in a subsidiary manner to the legislation applicable to generation auctions (Law No. 10.848/2004 and Decree No. 5.163/2004), replacing Law No. 8.666/1993”, said the ANEEL.

Among the proposed adjustments to comply with the new legislation are simplifications in the documentation to be submitted by bidders and changes in the deadline for submitting appeals.
