The Federal Government released last night (31), at the last minute and in an extra edition, the Decree No. 11.021/2022, extending the entry of new NCMs (Common Mercosur Nomenclature) on the national market for May 1st this year.

The measure, therefore, changes the Decree No. 10.923, of December 30, 2021, which provided for the entry of new TIPI (Tax Incidence Table on Industrialized Products).

With this, the entry of new nomenclatures for photovoltaic modules and kits, which were scheduled for today (1st), was extended by one month, as informed by report from Canal Solar.

Check below, in full, the decree signed by the President of the Republic, Jair Bolsonaro (PL):

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferred on it by art. 84,caput, section IV, of the Constitution, and in view of the provisions of art. 4th,caput, of Decree-Law No. 1.199, of December 27, 1971,

DECREE:

“Art. 5 The following are revoked, as of May 1, 2022:

“Art. 6 This Decree comes into force on the date of its publication and takes effect from May 1, 2022.” (NR)

Art. 2 This Decree enters into force on the date of its publication.

    Good afternoon!

Decree 11.021/22, published last night, extends the entry into force of the new TIPI, approved by Decree nº 01/05, to 10.923/2021. However, the entry of new NCM's continues today, 01/04/2022. Therefore, it will be necessary to adapt the old TIPI to the new TEC.

    In practice being objective.
How many % will the Products have IPI?
    Will ICMS be charged?
Will the percentage table be published and which products in the sector will be subject to taxes?
