GD's Legal Framework comes into force, but will be vacant for 12 months

Legislation provides that requests made during the period remain within the current rules, until the end of 2045

A Law 14.300 / 2022, which creates the GD Legal Framework, was published this Friday (07) in the DOU (Official Gazette of the Union), after sanction, with vetoes, by President Jair Bolsonaro (PL). But, after all, when do the defined rules come into effect?

Despite having come into force today, the legislation provides for a transition period for projects that are requested within 12 months of the publication of the Law.

In other words, all projects in GD, already installed or whose access request occurs until January 7, 2023, will be valid within the current compensation rules provided for in 482 Resolution (Normative Resolution No. 482/2012), until December 31, 2045.

This is the so-called vacancy period, as explained by Pedro Dante, partner in the energy and infrastructure area at Lefosse Advogados. “There are 12 months to stay in the current regime for those who submit the access request (…) After this period, the transition rule provided for in the Law comes into play”, he explains.
